Special Prosecutor From Vigo County Will Handle Case Against Brazil Officer

CLAY COUNTY, Ind  – We told you earlier this week that a special prosecutor will be called into handle a DUI case involving a Brazil Police officer.

Assistant Police Chief Dennis Archer was arrested last Saturday morning after being stopped and testing at .09% BAC.

He was stopped by Indiana State Police for allegedly making an unsafe lane maneuver.

Clay County Judge Robert Pell agreed with Clay County Chief Deputy Prosecutor Zach Clapp that a special prosecutor be appointed to avoid any appearance of impropriety.

That special prosecutor will come from Vigo County.

Clapp said Judge Robert Pell has indicated he will keep the case in Clay Superior Court unless a request is made to move the case.

Meanwhile, Brazil Mayor told us earlier this week that Archer will remain with the department and no disciplinary action will be taken since he was not on duty and was not driving a city vehicle. He also pointed to his 19 year unblemished record with the department.
